EU Administrative Procedures in a Constitutional Perspective

The legitimacy that may stem from decision-making procedures in the EU is largely under-explored. This paper will critically explore the ability of constitutionally informed administrative procedures to structure administrative discretion in the Union. In doing so it will address the normative implications of Union constitutional principles – in particular, democracy, transparency and participation – for the design of administrative procedures.
