Slovak Action Against Asylum-Seekers Relocation Quotas and Its Implications for the Decision-Making within the EU Asylum Policy

The contribution will deal with the Slovak action against the Council Decision (EU) 2015/1601 of 22 September 2015 establishing provisional measures in the area of international protection for the benefit of Italy and Greece (case C-643/15 Slovakia v Council). The author will examine its wide legal and political context. He will analyse the basic arguments of Slovak Republic, the Slovak government position, performs a comparison with the views of doctrine on the legal challenges against the Decision 2015/1601 and deal with comparison with the similar action brought by Hungary (case C-647/15 Hungary v Council). By discussing the action, attention will be paid also to the decision-making processes within the framework of a common EU asylum policy. Apart from analysing the action itself (and the eventual decision of the Court of Justice in the case), the contribution will scrutinise wider legal aspects and challenges for the potential future crisis measures in the field of massive migration flows.
